WHAT YOU NEED TO KNOW ABOUT THE "TRANSACTION AND USE TAX " APPEARING ON THE SPECIAL ELECTION ON APRIL 15, 2025. ON JANUARY 9, 2025 THE OAKLAND CITY COUNCIL WHICH INCLUDED THE NEW COUNCILMEMBERS SWORN IN ON JANUARY 9, 2025; ROWENA BROWN, ZACK UNGER, AND KEN HOUSTON APPROVED ORDINANCE NO. 13833 C.M.S. 4.26.010[TITLE] This ordinance shall be known as the City of Oakland Transaction and Use Tax Ordinance...; 4.26.040 CONTRACT WITH THE STATE. Prior to the operative date, the City shall contract with the California Department of Tax and Fee Administration to perform ALL functions incident to the administration and operation of the TRANSACTIONS AND USE TAX ORDINANCE; provided, that if the City shall not have contracted with the California Department of Tax and Fee Administration prior to the date; 4.26.130 ENJOINING COLLECTION FORBIDDEN. 4.26.130  OF ORDINANCE. 13833 C.M.S.  WOULD MAKE THIS PROPOSED BALLOT MEASURE ILLEGAL ON ITS FACE.
THE CITY CANNOT INCLUDE A PROVISION THAT PROHIBITS A MEMBER OF THE PUBLIC FROM SEEKING REDRESS FROM THE COURTS.  ADDITIONALLY,  THE JUDICIAL BRANCH IS A CONSTITUTIONAL STATUTE, TO SETTLE ALL ALLEGED CLAIMS SEEKING EQUITABLE RELIEF.
