It would appear with the delay in responding it may have a lot to do with the fact that the escrow instructions were paper ONLY[note: no actual deposit of the $100,000.00] similar to the failure of Tagami not posting the $50,000.00.
Thus, the scheme of FRAUD and LARCENY etc. Which are some of our Cause of Action in both FAC and SAC. This is why the court wrongfully dismissed our complaint.
Tagami, needed first to secure the ENA from the Port[on its portion of the Army Base development] in order to give a valid argument to the City to be selected as the presumptive developer to receive the ENA on the City side of the Army Base Development. The FRAUD started with the Port.
Lets see how the Port is going to respond. THE BURDEN IS ON THE PORT TO SHOW EVIDENCE OF THE DIRECT POSTING OF THE $100,000.00 DEPOSIT.
